The National Cohesion and Integration Commission (NCIC) has called for the arrest of Moses Kuria over incitement and has written to the Inspector of Police and the Director of Public Persecutions (DPP Keriako Tobiko) to investigate the matter.

In the letter written by NCIC Chairman Francis Ole Kaparo to the inspector of police, the commission argues that the utterances by Kuria are likely to ignite tension between certain sections of society and thus needed to be investigated.

“The commission is aware of the utterances made by Hon. Moses Kuria, MP of Gatundu South constituency on 7th July 2015 at his constituency while he was launching a National Youth Service program,” read the letter in part.

“These utterances in the opinion of the commission contravene Section 96 of the Penal Code thereby requiring investigations from your end.”

Kaparo has also said that the commission will petition Chief Justice Willy Mutunga to intervene in another criminal case on Kuria pending before the courts to be expedited.

Moses Kuria had on Tuesday called on his constituents to slash anyone who was opposed to the National Youth Service.

“Hapa Gatundu, ni militia yangu, nimewapatia mapanga, kata mtu kama utakata staki ujinga /Here in Gatundu, this is my militia, I have given you pangas, slash anyone you want to,” he said Kuria.

Yesterday, The Director of Public Prosecution Keriako Tobiko said he will move to court under a certificate of urgency next week to seek the cancellation of bail given to Kuria in a previous case of incitement. Tobiko also ordered the police to hasten investigation and forward the file for action.

NO REGRETS, SAYS KURIA

Moses Kuria however called a press conference and denied that he incited people. He maintained that his utterances were misconstrued.

“I don’t regret the fact that I uttered them, I only regret that it was misconstrued”.
