Jaguar involved in car accident that killed two

Kigeugeu hit-maker, Jaguar, is caught up in a controversial road accident involving his range rover that left two young men dead along the Makutano-Sagana highway.

According to eye witness accounts, the driver behind the wheel at the time the accident took place was a woman, who is said to have stopped a few metres from the scene, only for Jaguar to appear later and allege to have been the one driving the car.

The deceased, who died on the spot, were riding on a boda boda and have been identified as Joseph Maingi and Mugo Abdalla.

The road is under construction, so the vehicles needed blocking to pave way for other road users and still give time to the constructors. The driver of the said Range rover did not wait in line for cars to be cleared from her side, she was from Sagana heading to Makutano while the two were heading to Sagana.

That’s when she hit the duo, who were almost joining the highway. The ‘boda boda they were using went to one side, while the two young men fell on the other side. They both died on the spot. Jaguar, the alleged owner of the vehicle came around 3.30 and said he was the one driving the vehicle, even though the eye witnesses saw the lady driving it.” Read a section of a witness account that was shared on the popular Facebook page Buyer Beware.

Did Jaguar take the fall in killing of boda boda drivers?

Jaguar posted on his Facebook page that he was involved in an accident where lives were lost but didn’t respond to the allegations that he was taking the fall for someone else.

“It is with grief that I share this post today. As it is now public, I was involved in a car accident. Sadly, lives were lost in the incident.

It isnt any ones will to wake up and be involved in an accident such as this.

My heart felt condolences to the families and friends of those affected. I would like to assure all concerned that due process of the law is being followed to amicably resolve this.

I pray God grant strength to the families affected as we all go through this trying moment.

Lastly, lets avoid confrontational remarks in consideration to the pain it is causing the bereaved families.

The question on the minds of Kenyans who are following the story is this: if the witness accounts are anything to go by, why would Jaguar take the fall for the woman in question and who is she?

Causing death by dangerous driving is a criminal offence in the traffic laws of Kenya.

Section 46 of The Traffic Act, Chapter 403 of Laws of Kenya[1] provides that any person who causes death by reckless driving is “guilty of an offence”. This statutory provision is mandatory to the effect that any person who causes death by driving to be charged in court, where it would be determined whether the elements of the offence have been met.

“Any person who causes the death of another by driving a motor vehicle on a road recklessly or at a speed or in a manner which is dangerous to the public, or by leaving any vehicle on a road in such a position or manner or in such a condition as to be dangerous to the public, having regard to all the circumstances of the case, including the nature, condition and use of the road and the amount of traffic which is actually at the time or which might reasonably be expected to be on the road, shall be guilty of an offence whether or not the requirements of section 50 have been satisfied as regards that offence and be liable to imprisonment for a term not exceeding ten years “
