Kenya’s Supreme Court – more judges needed!

COURT INQUORATE – CASE ABANDONED

Kenya’s Supreme Court judges assembled this morning at 10am to hear the case put forward by three civil society applicants to have tomorrow’s election postponed but not enough judges turned up leaving the court inquorate and therefore unable to hear the petition. The election will therefore go ahead.

Chief Justice David Maraga abandoned the hearing after three judges failed to attend. One is unwell, one is abroad and a third said she was unable to come to court because her bodyguard had been shot and injured on Tuesday evening.

But Chief Justice Maraga was only joined in court by one other judge. Five judges are required to reach a quorum. Quite what happened to the other three judges isn’t clear.

When the Supreme Court overturned the August election, two judges failed to attend those hearings and the decision was taken by a majority ruling by four judges to two.

The question now arises – who will judge the judges?
