Relief for Motorists after IRA Clarifies on Insurance Coverage Past Curfew Hours

Road carnage in Kenya

The Insurance Regulatory Authority  (IRA) has issued a statement regarding Insurance coverage for vehicles driven after curfew hours saying “insurance companies cannot reject motor vehicle claims on the basis of timing”.

“As per the approved and standardized motor insurance policy documents, driving past and during curfew hours is not an inclusion in the current motor vehicle insurance covers.  As such, insurance companies cannot reject motor vehicle claims on the basis of timing,” IRA said in a statement.

The clarification by IRA follows notices circulating on social media, warning that “insurance companies will not process claims for any vehicles involved in accidents past curfew hours”.

The Insurance Authority further maintained that insurance companies are not charged with enforcing the Covid-19 containment measures, warning that action will be taken against those found contravening the set directives.

The Insurance Regulatory Authority is a statutory government agency established under the Insurance Act (Amendment) 2006, CAP 487  of the Laws of Kenya to regulate, supervise and develop the insurance industry.

President Uhuru Kenyatta last week announced new  Covid-19 containment measures including a countrywide curfew and a lock down of five counties namely, Nairobi, Kiambu, Nakuru, Machakos, and Kajiado.
