UPDATED 3:20pm Nairobi time:
ICC prosecutor Fatou Bensouda has finally withdrawn the criminal charges against president Uhuru Kenyatta.
A statement from the Prosecutors said the evidence had “not improved to such an extent that Mr Kenyatta’s alleged criminal responsibility can be proven beyond reasonable doubt”.
Uhuru Kenyatta had been charged with crime against humanity during the 2007 post election violence. Kenyatta has always denied the charges.
This comes just a day after judges at the ICC gave Bensouda a week’s ultimatum to withdraw the case if she does not have enough evidence to go to trial.
Bensouda had on numerous occasions accused the Kenyan government of not cooperating with the ICC.
Judges Kuniko Ozaki, Robert Fremr and Geoffrey Henderson had however stated that in the event that Bensouda withdraws the current case against Uhuru, she can still charge him afresh with the same offenses if she got the evidence at some point in the future.
